ACCOUNTANT SCREW US OVER!!!?

my husband and i only got back 800 bucks on our 2010 tax return. we both thought it was extremely low we thought we would be getting back around 6000. we asked him did we get the earned income credit he said NO we did not make enough. i went to see a new accountant who put all my information back in the computer and said oh yes we did qualify for th eearned income and we should have gotten back 6,300. i just called the old accountant to get copies of 2008, 2009 and 2010 tax returns to have a new accountant amend the 2010 and see if he screwed up on any others (i did not tell him this was the reason i needed them) now he is saying his office got flooded and he lost everything. can someone tell me if there is anything i can do here. i know i can go to the IRS but it will cost me 250 bucks plus ill have to wait like 8 weeks. did my old accountant break any laws with filing my tax returns wrong and then losing my returns???
